1 - Object
The purpose of these general terms and conditions of sale is to define the rights and obligations of the parties in the context of a distance sale of goods offered in the online shop www.arhome.it

2 - Contract Documents
This contract consists of the following documents:
• these general terms and conditions of sale
• order confirmation
Photographs illustrating products on the site are outside the scope of the contract and are provided for descriptive purposes only.

3 - Receiving orders
Any order confirmation signed by the validation click constitutes an irrevocable commitment by the customer that can only be called into question in the cases provided for in this contract in the articles "Right of withdrawal" and "Execution of the order".

4 - Order acceptance
The contract will only be concluded upon confirmation of the order by ARHome.
The customer will receive an acknowledgement of receipt by e-mail containing the order confirmation with all the constituent elements of the contract (including products ordered, prices, delivery dates, shipping costs).
ARHome reserves the right not to confirm an order for any reason relating in particular to a product supply problem, or a problem with the order received.
ARHome shall not be held liable for delivery errors due to inaccuracies or incompleteness in the completion of the purchase order by the customer. ARHome shall also not be held liable for any damage that may occur to the products after delivery to the carrier entrusted with their transport as well as for delays in delivery attributable to the latter.

5 - Product availability
The offers on this site will be valid as long as the products listed remain online and while stocks last.
ARHome also reserves the right to inform the customer, at the email address associated with his profile, of the possible unavailability of one or more of the products purchased. In the event of the purchase of a product that is no longer available ARHome shall refund (to the payment card or Pay Pal account indicated by the customer at the time of purchase or by bank transfer, the details of which shall be communicated after registration) the price and shipping costs incurred by the customer.

6 - Prices - Invoice
Prices are in Euro and include 22% VAT.
The price guaranteed to the buyer is that published on the site at the time of posting.
The prices of the products are final. They include any delivery charges. 

7 - Payment
The customer wishing to proceed with the purchase of the products must express this wish by means of a request made directly on the site, in the dedicated section, where, following the procedures indicated therein, he will send his purchase order and make the payment.
Payment is due from the moment the order is placed. The customer undertakes to pay the agreed price for the product ordered on the site (price of products and transport) using the available payment methods.
The customer guarantees to ARHome to have any necessary authorisations to use the payment instrument indicated in the order.
In the event of non-receipt by ARHome of payment,ARHome reserves the right to cancel the order. In case of payment by credit card, ARHome reserves the right to request the sending, within 24 hours, of a copy of the identity document proving the actual ownership of the credit card used, it being understood that, in the absence of the required submission, ARHome may refuse payment and cancel the order.
Payment data will be processed via a secure server-to-server connection using the SSL (Secure Sockets Layer) Protocol.

8 - Risk Transfer
The transfer of risk to the customer occurs upon delivery of the products to the carrier by ARHome. During the period of withdrawal mentioned in Article 13, the customer is responsible for the item as custodian. In the event of damage or destruction of the product while in the custody of the customer, the customer shall suffer all consequences.

9 - Order execution
The order will be carried out according to the terms specified on the Site and upon acceptance of the order by ARHome and in any case within 30 days after confirmation of the order subject to the availability of the ordered product and unless specifically agreed between the parties.
In case of stock depletion or unavailability of the ordered product, ARHome undertakes to inform the customer as soon as possible and to specify a possible deadline for renewed availability.
See Art. 6 concerning the availability of products.

10 - Delivery
The geographical area of delivery corresponds to the geographical area covered by the offer. Deliveries are made from Monday to Friday.
Products are delivered to the address indicated by the customer. Delivery is to the street level unless otherwise indicated. The request for delivery to the street level of an order (where available) must be indicated by the customer upon final confirmation of the order. Unless otherwise specified at the time of purchase, ARHome does not provide an installation service for the products sold.
ARHome, subject to the provisions of Article 6, undertakes to deliver the products to the address communicated by the customer in the purchase order, by means of the carrier entrusted with the transport of the same. ARHome shall not be held liable for delivery errors due to inaccuracies or incompleteness in the completion of the purchase order by the customer. ARHome shall also not be liable for any damage that may occur to the products after delivery to the carrier entrusted with their transport as well as for delays in delivery attributable to the latter.
ARHome delivers throughout Italy. Deliveries to uncomfortable postcodes (for example Venice Laguna) may result in variations in the indicated transport rates.
If the customer intends to place a purchase order via the site from abroad, it is obligatory to provide a delivery address in Italy. Delivery is made by couriers selected by ARHome; Postal Boxes are not considered valid addresses for delivery purposes.
The delivery document issued by the carrier, dated and signed by the customer upon delivery of the product shall constitute proof of transport and release of the good.
Upon delivery, the customer shall check the content, conformity and condition of the product(s).
In the event of delays, breakdowns, total or partial loss or other problems, the customer shall have recourse to the carrier without the liability of ARHome shall never be held liable.
Therefore, on delivery, ARHome recommends the customer to check the condition of the delivered products before signing the receipt.
If anomalies are found, the customer must refuse to accept delivery of the products or make detailed and dated reservations in writing. These reservations must be confirmed to ARHome by registered letter with acknowledgement of receipt within three (3) working days after delivery of the products.

11 - Withdrawal of products in the event of the customer's absence
In the event of the absence of the addressee during delivery, the carrier shall leave a note at the delivery address indicated by the customer. If the addressee is also absent on the second delivery attempt, the products shall be collected at the address and in the manner indicated by the carrier.
If the products are not collected within the deadline set by the carrier, they will be returned to ARHome which reserves the right to refund the price of the products, leaving the shipping costs to be borne by the customer.

12- Right of withdrawal
The customer has the right to withdraw from the Contract, without any penalty and without specifying the reason, upon receipt of the order confirmation sent by ARHome no later than fourteen working days after receipt of the product at the address indicated for delivery.
Full proof of receipt is the date on the delivery note.
The customer may exercise the right of withdrawal by means of a notice (including the recipient's details, order number and date of receipt) to be sent to the following e-mail address ordini@arhome.it.
If the product has already been delivered, the customer must return it to ARHome. To this end:
- the deadline for returning the product is fourteen days from the notice of withdrawal (in the case of return by the customer, the customer must provide proof of shipment). For the purposes of the deadline, the product shall be deemed to have been returned at the moment it is handed over to the post office and/or accepting carrier.
- if there has been delivery of the product, the substantial integrity of the product to be returned is an essential condition for the exercise of the right of withdrawal. the customer must send the product properly wrapped and packaged; ARHome does not accept damaged returns, but kept in a normal state of preservation, stored with the use of normal diligence. Products damaged by detergents/additives, or products damaged by the customer through inexperience shall not be replaced or refunded. The customer shall place a copy of the delivery document received inside the packaging box. The transport risks for the return of products shall be borne entirely by the customer.
- The costs of returning the goods to ARHome shall be borne by the customer. If the customer exercises the right of withdrawal in accordance with the provisions of these terms and conditions, ARHome shall reimburse the sums paid by the customer on the same means of payment used by the customer for the original transaction (credit card, paypal, bank transfer), unless otherwise indicated by the customer.

Reimbursement will be made, free of charge, within fourteen days from the date on which ARHome has become aware of the customer's exercise of the right of withdrawal.
As stipulated in the legislative decree 6/9/2005 n. 206 and Art.55 of the Consumer Code, the right of withdrawal governed by these terms and conditions of sale does not apply to goods made to measure or clearly personalised or which, by their nature, cannot be returned or are liable to deteriorate or expire rapidly.

13 - Guarantee
In order to guarantee high quality standards, the products undergo quality control procedures by ARHome before being shipped. However, in the event of faults, the customer benefits from the manufacturer's 24-month legal guarantee. To this guarantee is added the 'satisfied or reimbursed' guarantee of ARHome, valid for 30 days after delivery, provided that it has been used normally and in accordance with the recommendations in the documents enclosed with the products and in the relevant instruction manuals.
In any case, the products sold benefit from the legal guarantee against hidden defects provided for in Articles 1641 et seq. of the Civil Code.
Finally, some products benefit from an extended warranty. In these cases, the terms and duration of the guarantee are specified in the guarantee certificate delivered with the product. The latter does not cover damage, breakage or malfunction due to failure to comply with the precautions for use.
To activate the guarantee, the customer returns the product to ARHome at their own expense by enclosing the original order receipt.
The product will be replaced with an identical product and sent to the customer at the expense of ARHome, except in the event of unavailability or cessation of production of the product itself. In the latter hypothesis, ARHome will proceed to refund the price of the product to the customer.

14 - Use of the site
The product descriptions and images on the site correspond. The photographs and videos presenting the products accompanying the descriptive information are published on the site for descriptive purposes, taking into account the fact that the quality of the images, including an exact display of the colour variants, may depend on the software and computer tools used by the customer when connecting to the site. ARHome accepts no liability for problems caused to the customer by the use of the site and the technologies used, as these are beyond its control.

15 - Intellectual and Industrial Property Rights
ARHome informs you that the site, as well as all trademarks and distinctive signs used in connection with the sale of the proposed products, are protected by the applicable intellectual and industrial property rights and that any reproduction, communication, distribution, publication, alteration or transformation thereof, in any form and for any purpose whatsoever, is prohibited. ARHome reserves the right to take legal action to protect these aspects.

16 - Personal Data Protection
ARHome is the owner of the personal data collected at the time of registration on the site, as well as those subsequently communicated at the time of purchase by the customer, with the exception of the data relating to the payment procedure for which reference is made to the banking institutions through which the transaction takes place. For information on the processing of personal data, including the rights under Art. 7 of the Legislative Decree. 196/03, please refer to the detailed information at www.arhome.it

17 - Electronic signature
The 'validation click' constitutes an electronic signature.
This electronic signature has the same value between the parties as a handwritten signature.

18 - Integrity of the contract
These general terms and conditions constitute the entire obligations of the parties.
No other general or particular conditions communicated by the customer may be included in or deviate from these general conditions.

19 - Nullity
Should one or more provisions of these general terms and conditions be deemed invalid or declared invalid by application of a law, regulation or following a final decision by a competent jurisdiction, the other provisions shall retain all their force and effect.

21 - Applicable law
The sales contract between the Customer and MCM SRL is concluded in Italy and governed by Italian law.
