Terms of service

1 - Object
The present general conditions of sale aim to define the rights and obligations of the parties in the context of a distance sale of goods offered in the online store www.arhome.it.

2 - Contractual Documents
This contract consists of the following documents:
• the present general terms and conditions of sale
• the order confirmation
The photographs illustrating the products on the site are not part of the contractual scope and are provided for descriptive purposes only.

3 - Order Receipt
Any order confirmation signed by the validation click constitutes an irrevocable commitment of the customer, which can only be called into question in the cases provided for in this contract in the articles "Right of withdrawal" and "Execution of the order".

4 - Order Acceptance
The conclusion of the contract will only take place upon confirmation of the order by ARHome.
The customer will receive an email notification confirming the order with all the elements constituting the contract (including ordered products, prices, delivery dates, shipping costs).
ARHome reserves the right not to confirm an order for any reason related in particular to a product supply issue, or to a problem concerning the received order.
ARHome will not be held responsible for errors in delivery due to inaccuracies or incompleteness in the completion of the purchase order by the customer.ARHome will also not be held responsible for any damages that may occur to the products after delivery to the carrier responsible for their transport, as well as for delays in delivery attributable to the latter.

5 - Product Availability
The offers contained on this site will be valid as long as the listed products remain online and until stocks last.
ARHome also reserves the right to inform the customer, at the email address associated with their profile, of the possible unavailability of one or more of the purchased products. In the case of purchasing a product that is no longer available, ARHome will proceed with the refund (to the payment card or the PayPal account indicated for the purchase or via bank transfer, the details of which will be communicated after registration) of the price and shipping costs incurred by the customer.

6 - Prices - Invoice
The prices are expressed in Euros and include VAT at 22%.
The price guaranteed to the buyer is the one published on the site at the time of submission.
The prices of the products are final. They include any delivery charges.

7 - Payment
The customer who intends to proceed with the purchase of the products must express this intention through a request made directly on the website, in the specifically dedicated section, where, by following the procedures indicated therein, they will send their purchase order and make the payment.
The payment of the fee is due from the moment of the order. The customer agrees to pay the agreed price for the product ordered on the site (price of the products and shipping) using the available payment methods.
The customer guarantees to ARHome that they have any necessary authorizations to use the payment method indicated at the time of order.
In case of non-receipt by ARHome of the payment, ARHome reserves the right to cancel the order. In the case of payment by credit card, ARHome reserves the right to request the sending, within 24 hours, of a copy of the identity document proving the actual ownership of the credit card used, it being understood that, in the absence of the requested sending, ARHome may refuse the payment and cancel the order.
The payment data will be processed through a secure server-to-server connection using the SSL (Secure Sockets Layer) Protocol.

8 - Transfer of Risks
The transfer of risks to the customer occurs upon delivery of the products to the carrier by ARHome. During the withdrawal period mentioned in Article 13, the customer is responsible for the item as a custodian. In case of damage or destruction of the product during the customer's custody, the customer will bear all consequences.

9 - Order Execution
The order will be executed within the terms specified on the Site and upon acceptance of the order by ARHome and in any case within 30 days following the confirmation of the order, subject to the availability of the ordered product and unless otherwise agreed between the parties.
In case of stock exhaustion or unavailability of the ordered product, ARHome commits to informing the customer as soon as possible and to specify a possible date for renewed availability.

10 - Delivery
The delivery geographical area corresponds to the geographical coverage area of the offer. Deliveries are made from Monday to Friday.
The products are delivered to the address indicated by the customer. Delivery is understood to be at street level unless otherwise specified. The request for delivery to a floor of an order (where available) must be indicated by the customer at the time of final order confirmation. Unless otherwise specified at the time of purchase, ARHome does not provide the installation service for the products sold.
ARHome, except as provided in art. 6, undertakes to deliver the products to the address communicated by the customer in the purchase order, through the carrier appointed for their transport. ARHome cannot be held responsible for delivery errors due to inaccuracies or incompleteness in the completion of the purchase order by the customer. ARHome also cannot be held responsible for any damage that may occur to the products after delivery to the carrier appointed for their transport, as well as for delays in delivery attributable to the latter.
ARHome delivers throughout the Italian territory. Deliveries to difficult postal codes (e.g. Venice Lagoon) may result in variations in the indicated transport rates.
If the customer intends to place a purchase order through the site from abroad, they must necessarily provide a delivery address in Italy. Delivery is made through couriers selected by ARHome; P.O. Boxes are not considered valid addresses for delivery purposes.
The delivery document issued by the carrier, dated and signed by the customer upon delivery of the product, will constitute proof regarding the transport and release of the goods.
Upon delivery, the customer must verify the content, compliance, and condition of the product or products.
In case of delays, damages, total or partial losses, or other issues, it is the customer's right to appeal to the carrier without ever implicating the responsibility of ARHome.
Therefore, upon delivery, ARHome recommends that the customer check the condition of the delivered products before signing the receipt document.
If any anomalies are found, the customer must refuse the delivery of the products or put their reservations in writing, detailed and dated. Such reservations must be confirmed to ARHome by registered mail with return receipt within three (3) working days following the delivery of the products.

11 - Collection of products in case of customer absence
In case of the recipient's absence during delivery, the carrier will leave a notice of passage at the delivery address indicated by the customer. In case of the recipient's absence also on the second delivery attempt, the products must be collected at the address and according to the methods indicated by the carrier.
In case of non-collection by the deadline set by the carrier, the products will be returned to ARHome which reserves the right to refund the price of the products, leaving the shipping costs to be borne by the customer.

12- Right of withdrawal
The customer has the right to withdraw from the Contract, without any penalty and without specifying the reason, starting from the receipt of the order confirmation sent by ARHome within and no later than fourteen working days from the receipt of the product at the address indicated for delivery.
"The date indicated on the delivery note serves as full proof of receipt."
The customer may exercise the right of withdrawal through a specific communication (including the details of the recipient, the order number, and the date of receipt) to be sent to the email address ordini@arhome.it.
If the product has already been delivered, the customer is required to return it to ARHome. To this end:
- the deadline for returning the product is fourteen days from the communication of withdrawal (in the case of return shipping by the customer, the customer must provide proof of shipment). For the purposes of the deadline, the product is considered returned at the moment it is delivered to the accepting post office and/or courier.
- if the product has been delivered, the substantial integrity of the product to be returned is an essential condition for exercising the right of withdrawal. The customer must ship the product properly packaged and packed;ARHome does not accept damaged returns, but those kept in normal condition, stored with the use of normal diligence. Products damaged by detergents/additives, or products damaged by the customer due to negligence will not be replaced or refunded. The customer must include a copy of the delivery document received inside the packaging box. The risks of transport for the return of the products are entirely borne by the customer.
- The costs of returning the goods to ARHome are the responsibility of the customer. If the customer exercises the right of withdrawal in accordance with the provisions of these sales conditions, ARHome will refund the amounts paid by the customer using the same payment method used by the customer for the original transaction (credit card, paypal, bank transfer), unless otherwise indicated by the customer.

The refund will be made, free of charge, within fourteen days from the date on which ARHome became aware of the customer's exercise of the right of withdrawal.
"As provided for by Legislative Decree 6/9/2005 no. 206 and by Article 55 of the Consumer Code, the right of withdrawal regulated by these sales conditions does not apply to goods that are made to measure or clearly personalized or that, by their nature, cannot be returned or are at risk of deteriorating or altering rapidly."

13 - Warranty
In order to ensure high quality standards, the products undergo quality control procedures by ARHome before being shipped. However, in the case of issues, the customer benefits from the legal warranty provided by the manufacturer for a duration of 24 months. This warranty is supplemented by the "satisfaction or money back" guarantee from ARHome, valid for 30 days following delivery, provided that the product has been used normally and in accordance with the recommendations stated in the documents attached to the products and in the respective instruction manuals.
In any case, the products sold benefit from the legal warranty against hidden defects provided for by Articles 1641 and subsequent of the Civil Code.
Finally, some products enjoy an extended warranty. In these cases, the terms and duration of the warranty are specified in the warranty certificate provided with the product. The latter does not cover damages, breakages, or malfunctions due to failure to comply with usage precautions.
For the activation of the warranty, the customer returns the product to ARHome at their own expense, attaching the original order receipt.
The product will be replaced with an identical product and sent to the customer at the expense of ARHome, except in the case of unavailability or discontinuation of the product itself. In the latter case, ARHome will proceed to refund the price of the product to the customer.

14 - Use of the site
The product descriptions and images on the site are accurate. The photographs and presentation videos of the products accompanying the descriptive information are published on the site for descriptive purposes, taking into account that the quality of the images, including an accurate display of color variants, may depend on the software and computer tools used by the customer at the time of connecting to the site.ARHome does not assume any responsibility for problems caused to the customer by the use of the site and the technologies employed as they are not dependent on its own will.

15 - Intellectual and Industrial Property Rights
ARHome informs that the site, as well as all the brands and distinctive signs used in relation to the sale of the proposed products, are protected by applicable intellectual and industrial property rights and that any type of reproduction, communication, distribution, publication, alteration or transformation, in any form and for any purpose, is prohibited.ARHome reserves the right to take legal action to protect these aspects.

16 - Protection of personal data
ARHome is the owner of the personal data collected at the time of registration on the site, as well as those subsequently communicated at the time of purchase by the customer, except for the data related to the payment procedure for which reference is made to the banking institutions through which the transaction takes place. 17 - Electronic signature
The "validation click" constitutes an electronic signature.
This electronic signature has the same value as a handwritten signature between the parties.

18 - Integrity of the contract
The present general terms of sale constitute the entirety of the obligations of the parties.
"No other general or particular condition communicated by the client may be included or deviate from these general conditions."

19 - Nullity
If one or more provisions of these general conditions are considered invalid or declared as such in accordance with a law, regulation, or as a result of a final decision made by a competent jurisdiction, the other provisions will retain their full force and value.

21 - Applicable Law
The sales contract between the Customer and MCM SRL is understood to be concluded in Italy and governed by Italian law.
